Interested....the computer crime statute (16-16-20) is rather lengthy, but I have included some of the
language. There are several internet sites where you can view 16-16-20 in its entirety. "It is unlawful
for a person to wilfully, knowingly, maliciously, and without authorization or for an unauthorized purpose
to:

(a) directly or indirectly access or cause to be accessed a computer, computer system, or computer
network for the purpose of:

(i) devising or executing a scheme or artifice to defraud;

(ii) obtaining
money, property, or services by means of false or fraudulent pretenses, representations, promises; or

(iii)
committing any other crime.

A.L.P...I would encourage you to call the FCSO or local police department (depending upon where your home is
located) and ask that your residence be added to the "property watch" list so that patrolling
officers can keep an eye on things. If the individual makes any threats to you or your family, notify law

I am worried that our house is being cased by a neighbor's son who has been arrested for burglary. I
found his arrests here. My husband let him in by accident. His initials are A.C. We have called his
parent's house to tell him to not come here again. We also called the local police who advised us to
call 911 if we see him on our property or staring from the road. I am scared.

Ken W....Thank you for your comments. Recent national events have illustrated how dangerous the law
enforcement profession can be, so it is very reassuring when citizens respond with positive comments. As for
the use of state constables, I can definitely tell you that they are a pool of tremendously qualified and
dedicated professionals who render an invaluable service to the FCSO and the community. While I am not sure
why state agencies do not utilize constables, our agency is glad to have them. Thanks for visiting our site.

Unjustice....We post comments that are complimentary and critical of the FCSO alike on this site. It is our
intent to post comments that promote a better understanding of the FCSO and our duties and responsibilities in
the community. Far from protecting "deadbeat dads", our agency gives priority to the service of
family court bench warrants regarding a parent who has failed to pay child support. In fact, if you have seen
the Sheriff's Litter Removal crew at work in Florence County, it is usually comprised mostly of
individuals who have been arrested by the FCSO pursuant to family court bench warrants. On average the FCSO
has between 20-35 inmates serving time at the detention center pursuant to family court bench warrants. I hope
this response addresses your concerns, and thanks for visiting our site.

Joe Henry....Each investigator at the FCSO is vested with the discretion (that is based upon years of
experience and training) to conduct an investigation based upon facts and circumstances. Each investigator has
their own approach (based on individual training and experience) regarding the handling of a criminal
investigation. As any investigator will no doubt tell you, there are at least two sides to every story, and as
the investigator was not there when the incident occurred, he or she must arrive at conclusions based upon
the facts gathered during the investigation. Regarding the wording of an incident report, a complainant or
subject who wishes to dispute any of the information contained in an incident report can do so by way of a
"supplemental" that is added to the original incident report. The wording and content of the
original incident report, however, will not change. Imagine if every suspect in a criminal investigation who
made a confession wanted to change the content in the incident report after the fact. A supplemental to an
incident report can be submitted through the Records Division at the FCSO. Hopefully this response answers

Is it customary for an investigator to contact the accused before they contact the complainant. And Actually
TRY to get facts straight before they investigate someone. The sheriff report Is worded Wrong and contains
misstatements, I have notified the person that gave me the report and she did not seem to have answers on what
I could do to get the wording right. Looking for answers!

Scranton....Accesssory after the fact to a class A,B,C felony or murder involves the following elements:
the
felony has been completed; the accused must have knowledge that the principal committed the felony; and,
the
accused must harbor or assist the principal felon. An example of this would be a good friend shows up at
your
house and asks you to hide the gun he used in an armed robbery he just committed, or he wants to hide
out in
your house, and you comply. Class A,B,C felonies are the most serious crimes such as armed robbery,
assault and
battery with intent to kill, burglary 1st degree, criminal sexual conduct 1st or 2nd degree, to
name a few. I

about the bond issue so now it makes since .just cant believe anyone would go out on a "limb" to get
someone out of jail especialy if they stole a car and ran from rehab while on the run shoplifted....wow!!!i am
so concerned about the growing number of victims that fall into the hands of the rising number of crack, crank
,whatever drug of choice that turns such wonderful ppl into thiefs and they lose their families and steal and
sell all they own for a little hit of it... thank u again i just know from past situations in my own life that
you have to reap what you sow and you have to pay for your mistakes as well as learn from them ..

Marcell....normally when a person is given a probationary sentence, there are many conditions that apply to
probation which usually include refraining from committing additonal crimes. However, the process leading to
prison can sometimes be lengthy from the time a person on probation commits a crime to standing in front of a
circuit court judge for a probation revocation hearing. Some of the necessary steps include the obtaining of a
warrant for violation of probation, an administrative hearing before a probation hearing officer, the issuance
of findings of the hearing officer and finally, a probation revocation hearing before a circuit court judge.
At all times during the aforementioned process, the probationee is entitled to a bond. If the person you
described was arrested for a criminal offense while on probation, he will be "facing the music" very
soon in the form of an arrest warrant for probation violation, notice to appear in front of a probation
hearing officer and an appearance before a circuit court judge, most of whom take a very dim view of a
probationee who willfully violates the terms and conditions of his/her probation by committing more crimes.

Shocked IM VERY CONCERNED AS TO THE CONDITIONS OF INMATES THAT ARE ARRESTED WHILE ONLY BEING OUT FOR 45 DAYS AT
THE MOST UNDER THE SUPERVISION OF THE PROBATION OFFICE FOR THE NEXT THREE YEARS DID DO THE SAME REPEATED CRIME
HE WAS ALREADY ON PROBATION FOR AND HE WAS WAITING TRIAL AND JUMPED BOND SEVERAL TIMES AND WAS ARRESTED AGAIN
WHILE ON PROBATION AND HASNT SERVED BUT 2 MONTHS AND ALREADY OUT AGAIN??HAVE I MISSED SOMETHING ??DID HIS
PAPERWORK GET OVERLOOKED ??DID HE PLAY MONOPOLY WHILE IN JAIL AND GET THE "GET OUT OF JAIL FREE
CARD"???IM A BUSINESS OWNER AND I KNOW THAT ALOT OF PEOPLE SUFFER WHEN PEOPLE STEAL AND SHOPLIFT AND TAKE
WHAT IS NOT THEIRS..IT IS WRONG THAT SUCH A CRIME IS SO EASILY DISMISSED OR OVERLOOKED .I AM CONFUSED AS TO

Mrs. Fleming....while I respect your opinion, I could not disagree more. The Richland County deputy initiated
blue lights and sirens pursuant to his official capacity in furtherance of his investigation into possible
criminal conduct. Had the individuals simply stopped when signaled to do so by the deputy, then a vehicle
pursuit and subsequent physical struggle would not have occurred. When the individuals chose to disregard the
lights and sirens of the deputy and flee, they became criminally responsible for the likely and forseeable
consequences of their actions, up to and including any injury to the arresting officer. Suppose that while
fleeing the deputy, the individuals crashed into a car with a family inside....surely you would want them
charged accordingly? What if they ran over a child crossing the street while they were fleeing? Keep in mind
that but for the actions of the individuals (which include failing to stop for a blue light and resisting
arrest) the deputy would still be alive. They could have stopped their vehicle when signaled to do so by the
deputy, they chose not to. They could have halted the foot chase when ordered to do so by the deputy, they
chose not to. They could have stopped the physical struggle by submitting to the authority of the deputy, they
chose not to. In short, they chose a course of action that ultimately led to the death of a deputy who was
working to keep the citizens of Richland County safe, and for that, in my opinion, they deserve to be charged.

Rita....while I do not presume to speak on behalf of the S.C. Dept. of Probation, Parole and Pardon Services,
I can tell you that our agency works with them on a regular basis, and you will not find a more dedicated and
professional group of law enforcement individuals. Each agent has a staggering caseload that grows larger with
each term of General Sessions court. Most work tirelessly to ensure that every individual on probation or
parole is properly supervised. I would encourage you to contact the Florence office of the SC DPPPS and make
them aware of any pertinent info you may have regarding criminal activity being committed by someone under
their supervision. I believe you will find them to be both responsive and professional.

how many of you guys think that young man should not been charge with manslaughter for that officer had a
heart attack. i dont think thats fair because if it was one of us they would not throu that much for us the

Sister....it is impossible to comment on your brother's situation without knowing more facts. Generally,
burglary involves the "unauthorized entry of a dwelling house of another with the intent to commit a
crime once inside." An actual "breaking and entering" into a dwelling is not required. The
"unauthorized entry" element is often viewed in the context of who has legal authority over the
residence. Additionally, the courts have consistently held that the intent to commit trespassing subsequent to
the unauthorized entry of a dwelling or building can support a charge of burglary. However, your brother will
be afforded due process of law which should end in acquittal if he is innocent.

ok my brother got arrested for burgalary but he did not attempt to break in or enter into a home...then again
the policemen said that he has trespass but my cousin said it was his home and he could be out there where
ever the incident had occured... all i'm saying is that i want answers on why the policmen arrested him
on some nonsense!!!!

MOMO....to a certain extent, every law enforcement officer is vested with discetion in deciding whether or
not to make an arrest after arriving to a call for service. What usually factors into the decision
making-process are things such as the existence of any corroborative information, witness accounts,
consistency in statements given by complainant and witnesses and the presence of any physical evidence, to
name but just a few. As the responding officer is rarely at the scene when the incident that gave rise to the
call for service actually occurred, the officer must try to objectively look at the situation and choose the
best course of action. It is very diificult to second-guess a responding officer who was in a position to
assess the situation firsthand. As to your other concern, incident reports sometimes take a couple of days to
complete as they must be typed, reviewed and coded. The FCSO makes very effort to provide incident reports in
a timely fashion, particularly to victims. While I regret that your recent experience with the criminal
justice system was not a positive one, I would encourage you to call if you encounter further problems with a

LAST WEEK MY NEIGHBOR PULLED OUT A GUN ON ME AND MADE RACIAL REMARKS TO ME AND MY FAMILY.. THE POLICE CAME
OUT AND THIS GUY WAS NOT ARRESTED. WHAT I WANT TO KNOW IS WHY NOT??? AND WHEN I CALLED TO GET MY POLICE
REPORT IT WAS NOT READY WHEN IT SAID IT WAS SUPPOSE TO BE SO I COULD GET MY WARRANT COMPLETED AND WHEN I ASKED
FOR THE NAME OF THE NEIGHBOR (DUE TO THE FACT THAT I DONT KNOW THEM) I WAS DENIED THAT INFORMATION AS WELL..I
DONT UNDERSTAND HOW SOMEONE COULD SHOW SUCH VIOLENCE TO SOMEONE AND NOT BE ARRESTED AND HOW COME WHEN YOU TRY
